WEB HOSTING POLICY

 
 

All hosting packages provided by netAugusta.com may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any servers location federal, state or city law are prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless netAugusta.com from any claims resulting from the use of service which damages the subscriber or any other party. 
 
Prohibited are sites that promote any illegal activity or present content that may be damaging to netAugusta.com servers, or any other server on the Internet. Links to such materials are also prohibited. 
 
Examples of unacceptable content or links:  

  • pirated software

  • hacker programs or archives

  • Warez sites

NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A USD 50.00 CANCELLATION FEE WILL APPLY. ADDITIONALLY, netAugusta.com WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS. 

  1. "UNLIMITED" USAGE POLICIES AND DEFINITIONS

    What "Unlimited" means. netAugusta.com does not set an arbitrary limit or cap on the amount of resources a single Subscriber can use. In good faith and subject to these Terms, netAugusta.com makes every commercially reasonable effort to provide its Subscribers with all the storage and bandwidth resources needed to power their web sites successfully, as long as the Subscriber's use of the service complies with these Terms. By not setting limits on key resources, we are able to provide simple, consistent pricing to our Subscribers as they grow their websites. As a result, a typical website may experience periods of great popularity and resulting increased storage without experiencing any associated increase in hosting charges.

    What "Unlimited" DOES NOT mean. netAugusta.com employs complex mechanisms to protect its Subscribers and systems from abuse. netAugusta.com's offering of "unlimited" services is not intended to allow the actions of a single or few Subscribers to unfairly or adversely impact the experience of other Subscribers.

    netAugusta.com's service is a shared hosting service, which means that multiple Subscriber web sites are hosted from the same server and share server resources. netAugusta.com's service is designed to meet the typical needs of small business and home business website Subscribers. It is NOT intended to support the sustained demand of large enterprises or non-typical applications better suited to a dedicated server.

    netAugusta.com will make every commercially reasonable effort to provide additional resources to Subscribers who are using their website(s) consistent with these Terms, including moving Subscribers to newer and bigger shared servers as necessary. However, in order to ensure a consistent and quality experience for all Subscribers, netAugusta.com does place automated safeguards to protect against any one site growing too quickly and adversely impacting the system until netAugusta.com can evaluate said sites resource needs.

    Unlimited Hosting Space. netAugusta.com does not set arbitrary limits on the amount of disk space a Subscriber can use for the Subscriber's website, nor does netAugusta.com charge additional fees based on an increased amount of storage used, provided the Subscriber's use of storage complies with these Terms. Please note, however, that the netAugusta.com service is designed to host websites. netAugusta.com does NOT provide unlimited space for online storage, backups, or archiving of electronic files, documents, log files, etc., and any such prohibited use of the Services will result in the termination of Subscriber's account, with or without notice. Accounts with excessive number of files negatively affect the performance of the server and netAugusta.com may request that the number of files be reduced to ensure proper performance.

    Unlimited File Transfer. netAugusta.com does not set arbitrary limits on the amount of visitor traffic a web site can receive or on the amount of content a Subscriber can upload to his/her/its website in a given month, nor does netAugusta.com charge additional fees based on increased use of bandwidth, as long as the Subscriber's use of the Services complies with these Terms. In most cases, a Subscriber's web site will be able to support as much traffic as the Subscriber can legitimately acquire. However, netAugusta.com reserves the right to limit processor time, bandwidth, or processes, memory, or number of files in cases where it is necessary to prevent negatively impacting other Subscribers.

  2. IRC
    We currently do not allow IRC or IRC bots to be operated on our servers. 

  3. Server Abuse
    Any attempt to undermine or cause harm to a server or customer of netAugusta.com is strictly prohibited. As a subscriber/reseller, you are responsible for your account as well as your customer accounts if you are reseller. Should you or your end-customer violate the Terms of Services outlined within, your account will be cancelled without chance of refund.
     
    All sub-networks, distributive hosting sites and dedicated servers of netAugusta.com must adhere to the above policies, with the exception of system resources in respect to dedicated servers. 

  4. Billing
    By the Account Activation Date of each month/year, netAugusta.com shall either: (1) debit the client's credit card (when such information has been provided by the client); or (2) deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month/year. When an invoice is delivered to the client, payment shall be remitted to netAugusta.com by no later than the specified payment due date. netAugusta.com shall be entitled to immediately terminate this agreement for client's failure to make timely payments. You will be provided with an invoice based on your billing cycle. It is the client's responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with another credit card account number within 48 hours. If we do not receive a response within 48 hours, the account, and all accounts under that account plan, will be suspended. 

  5. Service Fees
    Certain services carry a set-up fee charged by netAugusta.com to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to netAugusta.com and agrees to pay any and all fees incurred by client. Because the services are provided based on your billing cycle, the client will be responsible for service fees incurred based on your payment cycle, regardless of when client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded. If client has retained the services for one year and has pre-paid netAugusta.com for such services, the client will be responsible for service fees for the entire year. 

  6. Account Deactivations
    Any account deactivated due to non-payment will require a reactivation fee of USD 5 prior to reactivation. 

  7. Cancellation & Refunds
    We DO NOT refund partial monthly fees to accounts. We require 90 Days notice for a cancellation. 
     
    You must use only the following method to deliver a official written notice of cancellation:  Please send us an email to billing@netAugusta.com. On receipt your account will be pending cancellation within 24 hours. Please include your Name, domain name, username, password and your reason for canceling.

  8. Refusal of Service
    We reserve the right to refuse, cancel or suspend service, at our sole discretion. 

  9. Limitation of Liability
    netAugusta.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from netAugusta.com servers going off-line or being unavailable for any reason whatsoever. Furthermore, netAugusta.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of netAugusta.com servers. All damages shall be limited to the immediate termination of service.

  10. Violations
    Violations of these Policies should be referred to support@netAugusta.com. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation. 

  11. Disclaimer
    netAugusta.com cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by netAugusta.com are resold. Thus, certain equipment, routing, software and programming used by netAugusta.com are not directly owned or written by netAugusta.com. Moreover, netAugusta.com holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as netAugusta.com sees fit. 

  12. Account Activation
    By activating your account with netAugusta.com, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information. 
     
    NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem. 

  13. End-user Support
    netAugusta.com agrees to support all customers and end-user customers through the facilities provided on our website (live chat and customer support). Our guaranteed service-level response to customer support inquiries is 24 hours with 85% of issues resolved within 12 hours. Should we fail to meet these guidelines, netAugusta.com will refund the customer with pro-rated amount for the duration of problem occurred.

  14. 100% Server Uptime Guarantee
    netAugusta.com guarantees 100% service (http, ftp, pop, imap, smtp) uptime on all hosting plans. Should we fail to deliver this for any given calendar month, your account will be refunded a pro-rated amount for the duration of excessive downtime. 
     
    netAugusta.com reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
